Open Question: Is this a discrimination?
I am an International student that currently live in Minnesota. I rented a room that belong to the Sorority house ( the organization belong to my school, but the house is not). The landlord said after May this year I won't be able to rent anymore because I am not belong to the Sorority group. So if I want to renew my lease I have to join in the Sorority. Is it a discrimination since here is what I found in Minnesota law :
"According to Minnesota law, landlords cannot legally refuse to sell, rent or lease housing to potential tenants, or have different rental terms, on the basis of race, color, creed, religion, national origin, sex, marital status, sexual or affectional orientation, disability, or reliance on public assistance. (204) There is one exception to this: an owner living in a one-family unit may refuse to rent part of the premises on the basis of sex, marital status, sexual or affectional orientation, disability, or reliance on public assistance. (205)"
Yes, I wish I could pledge with them but my time was full with work and study and leadership participate. The Sorority that I stay with require a lot of attending in my view point and I dont think I could make it
In the state law it said discriminate between creed is also a discriminate. Isn't that sorority is also a creed?
Not like I am gonna give them any trouble. I thought it just interesting to know

Open Question: Is it possible to report your landlord for not doing their job?
I live in apartments in Beckley, West Virginia. My landlord is not doing her job at all. This apartment building only has 3 apartments which are all on top of each other. The people who live under us have been beating on the ceiling of their apartment all hours of the day, and night too. We asked them to stop ourselves, did not help. So we told the landlord about it, she told us to call the law and they did nothing about it either. So we finally got her to come over here, and she told them to stop. The banging stopped last night, but then today they are up to their same old same old again. She said she can't evict them without proof. But what proof does she need when she heard the banging herself? So did 2 people who work for her on the apartments. I don't understand. Is there a way to report a landlord for not doing their job as a landlord? I paid rent already, and she won't give rent back to anyone. And I have no money to go anywhere else. I live on a fixed income on SSI. So I don't have many options.
When we called the law, the law specifically said they can't do anything about it because we live in a apartment we should expect things like that to happen. That the only person that could do anything about it was the landlord. I'm completely stuck on what to do.
The people do have a child, and the guy Christian likes to blame the child with the banging... But the child is only 4 or 5 years old and is barely 2ft. So how is he doing the beating the ceiling? Sometimes when the guy is banging on the ceiling it shakes our floors so hard it has even almost knocked stuff off our walls... and has knocked our movie shelves sideways.
And couldn't the Landlord also evict them on the grounds that they have drugs in the apartments. My boyfriend and I have on numerous occasions smelt marijuana smell drifting up into our bathroom from their apartment.
We also have a leaky water pipe in our kitchen that our landlord refuses to even speak to us about fixing. All repairs and utilities are included in our rent.. The rent is $400 a month.. And the apartment honestly isn't worth it.
She witnessed the noise 1 time. Her workers witnessed the noise 1 other time while they were over here picking up trash. Because trash pick up is included in our rent.
Note:Tracy, I do think you're right about the just wanting the money. Because she wants the money to go play slot machines.
She did tell us and her workers she was going to evict them out. Then she turned right around and collected their rent money.

Open Question: Question about landlord/tenant responsibilities?
I recently moved out of a house where I rented two rooms. I paid first and last months rent, and one pet deposit when I bought my cat. That is all. My landlord is giving me a lot of issues about a damage payment.
They say I need to pay for replacing one rooms carpet, and ALL hallway carpet (which is public area). Why? My cat damaged a small area near the doorway (in my room). That is all, there are no major stains or other rips.
Im confused as to whether I should pay or not because they did take a pet deposit from me and I feel I shouldn't have to pay for a public area carpet either. But I want to do the right thing, and honestly, Im very uneducated about laws regarding that.
I already gave them 600 dollars to paint the rooms, which Ive been told really wasnt my responsibility as the walls all had normal wear and tear. (these rooms havent been updated in 10 years)
Also, can a landlord charge you for damages if they didn't take a security deposit?
I just want to make sure I make the right choices, and I dont want to fight something if I really am in the wrong. I just really feel they are trying to take advantage of me. They leave insulting messages (personal attacks) on my phone, and don't return my calls or answer my request for another copy of the lease.

Thanks for all the responses. My pet deposit was 100 dollars. The carpet is 9-10 years old... Meaning it hasnt been replaced since the landlord bought the house.

I forgot to mention, even if it is the prorated amount or such, I have said through email that I would take care of half of the cost... I was stupid and wanted to make them happy since I was still living there. Have I backed myself into a corner now?

Open Question: How and what do I do to get the tenants downstairs to move out? Any tips or ways to rid someone? ?
I need help!! I have been living here in my UPSTAIRS apartment (with my two small children) for six years. I love it here and do not want to move. My parents own this duplex. I am their daughter. People downstairs are smokers and continually smoke especially at night after we go to sleep. Before they moved in they stated they were going to smoke outside only but this isnt the case. My parents (landlords) have called them many times and they continually lie or state they wont smoke anymore but they always do!! Since then ive boughten two air purifiers and i can still smell the smoke. Our duplex is very old and smoke rises and goes into my place upstairs. My parents wont evict them b/c they pay the rent on time and keep the place clean and do all the yardwork outside.
What are some things i can do indirectly so that they will not want to live here anymore and perhaps leave on their own? Ive tried to play loud music a few times but i end up feeling too guilty and turn it off. Plus i dont want to risk the police coming over.
I need some ideas or plans that i can do without breaking the law that will send these people out of here. They wont leave no matter what b/c the apartment is really nice downstairs but the smoke is unbearable. I dont want my kids to breathe this crap in anymore!!!
Im not ready to move out.....trying to save money...am a single mom of two. Any ideas will be great.

Open Question: Does anyone have a link that shows the laws between landlords and tenants in Illinois?
I'm looking for laws specifically in Illinois. We're fairly new landlords and just bought a property in June. One of our tenants just got arrested for heroin possession (he was living there when we bought the place, so we hadn't done a background check). Since then, we found out he's on probation for cocaine possession in 2005. We have given him a 5-day eviction notice, but he has called us saying that he really has nowhere to go and wants to work something out. I know I'm going to sound like a wimp, but it would be so much easier for us if we just told him that we're obligated by law to evict him. We do feel bad for him...he's a 60-year-old man who's addicted to heroin & doesn't have anywhere to go. However, we are still definitely evicting him! We just want to have a nice way to explain to him that because of his problem, he has to go. So...what I'm blabbering on about...I just want to know if I can find complete info somewhere that tells the laws of Illinois between landlords and tenants. Thanks--

Open Question: Should I hide my pregnancy from my landlord?
My landlord seems like a pretty nice guy, but you never know sometimes.
I'm fifteen weeks pregnant and due right around the time my husband and I will have to renew the lease on our apartment. I don't think there are any kids or babies in this building. I'm worried that if the landlord finds out we'll have a baby living here, he won't renew our lease.
I know there are housing discrimination laws here in the US, but I'm not sure if they apply, and of course he could always lie and say it was for another reason. I would rather not have to fight him on it when I'm about to pop or have a new baby.
So should I try to hide my pregnancy? He's not in the building very often (only seen him here once in fact), so I guess it wouldn't be too difficult. I would feel terrible about the lie, but I would probably feel worse being homeless with a new baby! We only want to live here one more year before buying a house, so it would only be an issue this one time.
Ugh, I hate even having to ask this. It's been on my mind lately though since I'll probably be showing in a month or so. Any personal experiences with this issue are appreciated too. Thanks for your input!
Ha ha, thanks everybody. :) I'm certainly proud and happy, just worried about having to find a new place and/or fight with this guy while I have a new baby. And he doesn't ask or anything, that would be weird, lol. He just might be around more often soon (neighbor's getting evicted) so I thought I should decide what to do now.
I guess I'll just hope he doesn't notice or doesn't care if he does. I'm sure it's nothing to worry about, just the preggo worrying brain acting up. Thanks!

Open Question: How can I get out of my apartment lease?
I live in an in-law apartment above a guy's garage. He lives alone (has admitted to me that his wife left him) and is what I would consider an alcoholic (empty beer cans falling out of his drunk, etc.). I am a young female living alone. I had to move cross-country and only got to speak to my landlord and never meet him. I've been here about 2 months and I really don't feel safe, comfortable, or secure when he's home. About 3 days after I moved in he came upstairs yelling my name (he was definitely drunk) around 10 oclock at night, wanting to meet my dog. He will call me sometimes and bully me around, pretty much telling me how to do things (like how I should raise my dog). He is so unprofessional! Before I moved in, I had given him first month's rent and a security deposit, and even though our lease says he must give me a 24 hour notice before he enters the apartment, my mom came over to drop stuff off and he was inside changing a light bulb (breech of contract). I can't prove anything but I do not trust him, and him being an older man that lives alone and me being a young female that lives alone, I was hoping that this wouldn't be a problem, but I don't feel safe, bottom line. We (my husband and I - dual military, stationed in different locations...he met my landlord last week and doesn't like him at all) signed a one-year lease agreement. Nowhere in the lease does it say that if we had to break the lease, what it would cost us to terminate it earlier. How can I get out of this situation? Any help is appreciated, sorry it's long-winded.
Sorry for the confusion. The owner of the property, and my landlord, is the guy who lives in the home. The lease agreement is between us and him and we pay rent directly to him. There is no 3rd party, it is his property and I rent the in-law apartment from him.
There is no relation between any of us...

Open Question: got law suit lost per default !can they take my car?
i was evicted, stayed till end of time allowed, landlord filed suit, 1600.00, never got letter per law suit due to no forwarding address, my fault, lost due to default, this whole time didnt know i was sewed, i go to my car dealer today to make a payment he hands me a info request paper he got from the landlord who is suing me his attorney sent him for info on my car,,because car dealer is holding a lean on it ,,, any ways in ohio can they take my car? what can i do to stop them? will they take a payment??

Open Question: My Roommate moved out, Left Stuff, What do I do.?
I live in PA so any advice will be helpful but I am looking for specific advice on laws for PA.
My roommate moved out on Dec. 31. She broke our 12-month lease after 6 months. She left her bed set, entertainment center, couch and a few other misc. things behind. I know she was at the apartment on the 31st after midnight so legally she would be trespassing since she was no longer on the lease. She has paid all of the rent up to the end of December and only owes money for bills, and I will be taking her to small claims court if she does not pay them by the end of the month. She is now no longer on the lease, she does not owe rent money, and she does not have keys (that I know of), and the locks will be changed within the week.
My question is, when can i get rid of her stuff that is not taking up space in my living room. I'm not even looking to sell them, I will most likely donate the entertainment center and the couch to the salvation army or something. I just want it out. My new roommate was supposed to set up a payment plan with the old roommate concerning the bed set, but has not done so yet. The apartment manager, landlord, new roommate, as well as myself have tried to contact her, but she never answers. My apartment manager left her a voicemail saying that if she does not contact one of us by Friday the 2nd at 10:00p.m. then I have the right to do whatever with her stuff, but I want a second opinion before I get rid of it in case she decides to take me to court and my apartment manager lies and says she did not talk to the old roommate.
Also, who could I contact concerning my local laws. I don't have a lawyer, nor to I wish to contact one right now for advice. Should I try calling my local police district?
Thank you for the advice so far. We did not sign individual leases. Both our names were on one and the landlord basically just changed the names of the old and new roommate. we called my old roommate numerous times and left a voicemail saying if she does not get in contact with us within 24 hours to arrange pickup of her items that we will be disposing of them. She neglected to return our calls. Once again she is not on the lease anymore and she does not pay rent and she does not have a key to pick up her property so why should I keep it if its in my way. If you move into an apartment or house and there are items left there from the old roommates then that stuff should be yours to do whatever with.

Open Question: How can I protect myself against my pervert landlord?
My landlord keeps finding reasons to stop by my home during the day while I am alone. Yesterday he came by and I didn't answer the door. He then came back 20 minutes later with a hammer and proceeded to pound on the door with it. He is a weird little guy and has been coming onto me for years. One time he tried exposing himself to me. I was able to make him stop that time, but what I am afraid of is that he seems to be getting more sexually aggressive, He is always trying to grope at me. The scary thing is he has a key to the door. Our home is in need of repairs and he insists on doing them all himself, giving him the opportunity to oogle me daily. Are there laws against landlords who sexually harass their tenants. (It is bordering on stalking) What can I do?? Is it legal for me to change the locks since he has a key??
We are locked into the lease until June 2009
