Voting Question: What is wrong with my Ford Explorer?
2006 Explorer XLT 59,000 K&N filter, flowmaster 40, bull bar/off-road lights blah blah blah. Okay, I bought this car used in October. Since then..problem after problem... -parking brake -rear windshield wiper motor -failed inspection -rear axle seal (I know about the TSB) -Rear hatchback glass defective The dealer has fixed all this for free. So heres my new problem that has been developing. First off...when I'm driving around 40+ or below 2000 RPMS, the thing will vibrate, like you can feel it in the backs of the seats shaking you. I know there was a TSB about a vibration when going over 50, but dealer says thats not the problem. So this started about 3 weeks ago. Whenever I press lightly on the gas, I hear a hissing sound from under the dash (same as the one heard when turning off defroster). This also happens everytime it shifts gears. If I hit the gas harder, it goes away. Just a week ago, I noticed whenever I am going up a hill and have the air/heat on, the air just blows out of the defroster vents and not out of the floor/face vents. When you get over the hill, it begins to blow on the floor/face vents again. So my questions are, 1) Is this a problem or normal? 2) Are the vibration and the hissing related? 3) What are some later consequences if this is not fixed? 4) Should the dealer fix this under warranty? Resolved Question: Should I not pay the rent until problems are fixed? Or use rent money to pay for them? Details below?
We rent out house through a rental agency, we pay £475 per calender month. Our rent was due Christmas Day but agency do not open until Jan 3rd, so rent cannot be paid until then. Problems - We moved in on Jan 27th 2007, by the 17th Feb, we had made them aware of a problem with the patio doors, they do not open without being pulled really hard and all the insulation stuff has come off, so there is a ridiculous draft! Still nothing done! They did a rental inspection on the 28th April, made them aware of the patio doors (AGAIN!!!) and also the banister has come off the wall on the stairs! Still nothing. Then in October we noticed damp on the walls and windows in the main bedroom (mould growing) so I rang the agency straight away, as I have read what illnesses you can get from damp. We have a baby so I was very worried! A further rental inspection in November, showed them the patio doors again, showed them the damp, showed them the banister and they also tested the smoke alarms, which turned out not to be working either (we have since replaced the batteries). A week later they still didn't ring about the problems, so I rang twice, they said they contacted the landlord who will deal with the problems himself. So we waited and waited, still no-one came! I am debating whether to use the rent money to get the things sorted myself and just send them the receipt. What do you think?! (apologies for length of question) :o) In answer to your 'smug, saracastic and highly unhelpful answer estielmo' I do wipe it off the walls, I just dodnt think I needed to write my cleaning routine in the question. I also DO NOT live in England.... Grrrr, what an annoying person you are!! And even if I did live in a damp place, it doesnt mean it should be making mould grow on my walls and windows, idiot. yeah so i like this guy in my jrotc class, and we started talking like since october, and i started to relize i liked him and everytime we talk he looks straight into my eyes, but i never look back because i dont want him to think i like him or something, and everytime we have uniform inspection he stares at me alittle and then he says something, and everytime my ex boyfriend is talking to me or annoying me he gets up and defends me. do you think hes leading me on? or he likes me? or is just playing games with my head? because hes told people he didnt like really like me but he thinks im cute.. is that even possible? jrotc is a military based class. i like mia d's answer :) (more...)

Resolved Question: How long can I go without having auto insurance?
Sooo I'm in a pickle. I got a ridiculous ticket earlier this year. I forgot to pay it and my license got suspended. My insurance went up when me and my ex parted ways and my inspection is almost up. I'm going to get insurance again soon - but someone told me i'm going to start getting fined on the first of the year. Is this true??? I've been without it since October. (more...)

Voting Question: Do I have a case?/What do I do next?
Alright. Long Story. I live in Maryland and recently bought a used vehicle from a dealer. 2006 ford Explorer V6 - 52000 miles ~ 12,000 So i get the car october 10th, and everything is going good. On November 24th, they call me and say they need to do some tag work. So i say alright, go ahead and do an oil change at the same time, ill be in tommrow. So I get there and they say about 45 minutes. I wait about 2 hours...then go to investigate. I ask teh first service rep, and am told, the oil filters were on backorder, one should be delivered soon. So I wait again..and ask another person about 30 minutes later what the holdup is. They tell me they are waiting on an air filter. But wait....I just said oil change. So i keep investigating and find out my car was put in for a maryland state inspection. But no one wanted to tell me, they were just making up lies. So i find out at the end that they replaced fuel filter, air filter, oil filter, wiper blades, and rear axle seal. A total of 5 hours. All this work done WITHOUT my involvement. I did not sign at any point for this, nor was I told. So I ask why the inspection was done. They tell me its just a safety inspection and they owe it to me because I bought the car there. I ask why did you wait 45 days, and they cant come up with an answer. So I ask, why is it listed under maryland state inspection if it was sold inspected? And then they have a completely different answer. - Well because we have 30 days or 1,000 miles to report the insepction to MVA and we didnt, so we had to redo it and we found this stuff. Well why didnt they find it when they "inspected" it before? Plus I had put 5000 miles on the vehicle already....quite far past 1000. Also, when I bought the car, it was sold "as is", and I was told they would not replace the filters and such unless I paid. This work was all done for free. In conclusion - I just want to know what are they hiding from me? Can I press charges? Is this legal or illegal based on inspection laws? (more...)

Resolved Question: How do you sue a tenant for property damage in Arizona?
I rented my home for the first time this year to (mistake number one) a friend. A family member who is a agent helped me with a month to month lease agreement as well assisted me with being in compliance with my obligations as a landlord. We agreed on $900/month with a $400 deposit, and we would waive the pet deposit on her 3 dogs so long as the house returned to us in the condition she received it. We listed all personal property which included a toold shed that was lockied in the back yard, as well as a gym machine in one of the spare bedrooms. The tenant occupied the house for less than 6 months. The rental agreement specifically list that she is responsible for all lawn maintenance and would be responsible for any fines that incured from lack of care; we have a front yard that is gravel with some palm treese that were trimmed down before we left. During her stay she incured 2 fines for excessive weeds from the HOA totalling $100. It was agreed that the fines would be payed out of the secutiry deposit. Through a text message (she never called or even answered calls-always text messages) she notified us that she would be out of the home October 31, and if for what ever reason she needed to stay there longer then her rent would be prorated. On November 1 she called and asked us to come and walk through the house, but then made mention that she was having a garage sale at our home, and that most of her belongings were still in the home. I asked her to please have every thing cleaned out and then we would come look. Sunday she called to tell us that the house was cleaned out, and we asked her if my fiances father (listed on the rental agreement as the person authorized to make repairs, walk through, etc.) could meet her at the home the following Monday or Tuesday. Now she is a single mom and works two jobs, and her schedule is hectic. So I told her I was going there to look at it myself, and if every thing was no issues than I would mail her a check for her deposit minus the HOA fines. Now remeber that this is a new house, that was lived in literally 2-3 days a week with no kids or pets... Upon inspection I found the garage covered in car oil (which is not a huge deal, things happen, I get that), the wood shades had blinds broken from the strings and hanging down, ink stains on the kitchen floor, red stains on the kitchen counter top, all cabinets and floors sticky (we had a cleaning crew go through the house to make sure it was clean when we left) and the carpet-the carpet had huge yellow and purple stains on it, and not in one area, through out the entire house over 20 stains about 2"-9". I had my fiance call her and (because she didnt pick up the or return a call yet again) leave a message. He stated that he did not want to charge her to repair the kitchen floor or counter, or the blinds, or to have the house cleaned, or even charge her the prorated rent for the two extra days, how ever the carpet did need to be cleaned, and stains removed or signifigantly lightened. Again no response. So he sent her a text telling her she needed to return the keys, in which she said she needed her deposit back and had no idea about the stains, and that she had the carpet cleaned on Friday 10/31, came to take pictures on 11/2 and some how the stains appeared on 11/4 when I looked at the house. She has since been in the home and taken other items that were left behind. The carpet cleaners who did the original job are meeting with me next week along with a guy to do give me an estimate in replacing the carpet. I know that I have 14 days to give her a receipt for her $400 deposit and where the monies were spent. My questions are as follows: 1) Since she will not leave the keys any where or make time to meet some one to get them when is the day she left the home? We had no written notice, only a text message that she would "probably" be out on 10/31/08, but then she had a garage sale on 11/1/08 and sent another text on 11/2/08 that her items were out, but has been back since 11/6/08 to get items left. Can we charge her for every day she has the key? Is she still in possesion for every day she has keys and garage door openers? When would my 14 days expire to get her a receipt for her deposit? 2) The stains in the carpet are not normal wear and tear, and will more than likely have to be replaced-what are my rights as an owner to take a tenant to small claims court? It is apparent that $300 will not cover the cost of having the carpet replaced. Do I need to have her served with paper work to go to small claims court with in the 14 days? Do I have to have the carpet replaced with in 14 days? Is a estimate good enough? Any help will be greatly appreciated! Thank you thank you thank you!!! (more...)

Resolved Question: What can I do about getting a seller to sign a cancellation on an offer for a house?
We put in an offer to buy a house, contingent on inspections. Seller refused inspection (in writing) of plumbing, thus voiding the agreement. She was also VERY difficult when we asked for an inspection of the septic system (rural home). We signed a cancellation of the offer on October 13th. She still has not signed the cancellation. What can we do? We were supposed to close on November 7th...is there any way she can try to sue us for breach of contract? I should add that she is still holding our earnest money. So, if she's "moved on", she's doing so with our money.... Sorry-I'm not being clear-the realtor for the seller has my earnest money in escrow-however she will not release it until seller signs the cancellation. (more...)
