Open Question: What are our rights in regard to people who impersonate officers?
I didn't find anything on a thorough search of Google and nothing on here. In regard to American law, what rights to citizens have to determine the validity of someone who claims they are a federal/state officer and flashes a badge? I know if a cop tags your car on a dark country road, you have the right to continue driving until you get to a better-lit, more public place (while calling the 911 dispatcher to make your intentions clear), but what about calling an agency office to check badges? Can I really say, "Hey, Mr. FBI-man, lemme see your badge while I disappear into my apartment for a few minutes (to call the local branch)"? Seems like a right we should have, but I don't want to assume. (more...)

Open Question: Do you consider yourself a good public speaker?
PLEASE! Take time to read my little speech and critique it. It's supposed to be 5 minutes long. The speech topic is the National Theme: ?HOSA: Where One Person?s Passion Becomes Another Person?s Hero.? HOSA = Health Occupation Students of America MY SPEECH As children we were all afraid of something. Most of us were afraid of the dark; some of us were afraid of the boogey man or even going to school ? I know I was. The funny thing is that I don?t remember ever being afraid of any of these things but NOTHING on God?s green earth scared me more than the sight of blood, no matter how small. But this fear would not last. One day, when I was in the 4th grade my mom dropped me off at school and as always, I ran to the soccer field to get in some play time before classes began and what I saw would change my life forever. When I got to the dirt field I noticed a small crowd of people and weaved my way through the crowd to see what was going on. I saw the biggest pool of blood I have ever seen and hopefully that I would ever see. From that day onwards I was never afraid of blood. The story was that a kid who was about 10 years old came to school early and no one was there. He got bored and started swinging on the goal post. As he was swinging and playing the goal gave way, fell on him, and almost split his head in half. Now, the unfortunate miracle was that he didn?t die instantly but later died in the arms of his mom at the local hospital. I only wished I was there to comfort him and offer him some kind of hope. Let?s fast-forward to the present time. When I first came to the U.S from Nigeria in 2003 I was afraid and overwhelmed. I found myself in a foreign country and the only thing I could think about was: How can I survive here? When it came the time to choose a high school, my dad was trying as hard as he could to convince me to enroll in a school that specialized in specifics fields of study like Law, Art, Technology and Medicine. His grand plan was for me to become a medical doctor! To be honest with you, I had no interest in medicine but as fate would have it I?m in the medical field. As I speak to you right now I am halfway through my junior year clinical rotation and boy have I seen things? I have seen patients who not only are they physically helpless but emotionally hopeless. People who are longing, thirsting for someone to say: It will be okay. As I see these things, they remind me of that boy whose untimely death helped me overcome my fear of blood. I only pray that one day as a medical professional who was nurtured by HOSA and its principles I can bring comfort and peace to those who need it the most. If it was up to me, this years theme would be: ?HOSA: Where passion overcomes fear? and I can attest to that. (more...)

Open Question: I got a DUI ..... discriminated against !?
Hi I'm 22 I'm very responsible kid I currently attend Yale University.I have my own car, my own apartment, I'm an intern at a local law firm and I am currently a marketing and publishing manager. I have my head on straight, I've always made consciences decisions. I was visiting old High school friends back home in V.A. We decided to drive to Washington that night just to go clubbing. I had 1 beer and one shot before 10 because I knew I had to drive around 5 in the morning after the club closed. That was very little alcohol plus I gave it 5 hours to metabolize. I was perfectly fine was coordinated was not at all showing physical or mental signs of intoxication. But I was pulled over for going 72 in the 65 ..ludicrous then the cop requested if they could search my vehicle. I said I'm a law student I know my rights if you have to ask then that means you obviously don't have probable cause to search my car. Then the copped agreed then his attitude became completely pugnacious and he gave me a breathalyzer I said officer you can obviously tell I'm not intoxicated he said well you should know due to the implied consent law your required to take a breathalyzer then I agreed and blew into it. My alcohol content was .02 more that's less then a child thats been sucking on cough drops. I was arrested over night and my license is currently suspended for 7 days. Do you believe this was fair? Would he have arrested a 20 year old white male for having a damn .02 alcohol level? Do you believe I was discriminated against. Whats our input on the situation?Do you find it funny that must people that are 21 aren't charged with a DUI unless their blood alcohol level is AT LEAST a .08. On the police report he said I may have had a low BAC but I seemed to be affected which was a lie. I know his has nothing to do with being gay but this is my normal section and I feel comfortable getting answers from you guys thanks. (more...)

You can believe we live in a colorblind society but we don't and when was going 72 on the interstate ever considered speeding come on people are going 85 on the interstate I was in the SLOW LANEEEE !! Open Question: Where in the constitution does it specifically say "seperation of church and state"?
The only mention of religion it makes is this "Congress shall make no LAW respecting an establishment of religion, or prohibiting the free exercise thereof" This just meant that the church wouldn't be suppressed, nor given legal authority(unlike the church of england at that time) . This is quite different than intending to eliminate the religious dimension completely in politics. Government sponsored doctors (think VA) are still allowed to tell their patients their opinions, and so are teachers. If a teacher were "teaching" religion in a class where they weren't suppose to, it would be wrong. It wouldn't be a constitutional matter though, just a matter of inappropriate education to be handled on the local level. The undeniable fact is, congress still has not violated the first amendment. I don't know why people are whining. Complaing about things like "the president has to take the oath" is kinda silly. He doesn't have to, it's just for show. If you feel I am dearly mistaken about something, please tell me so in a reasonable manner and I will happily acknowledge my mistake. After-all, the get the "truth" is the point of asking these questions... Yes, but Jefferson's letter doesn't hold legal authority. You're right, I'm not a constitutional scholar. Far from it. My opinion doesn't have any legal merit. It's just an idea. I meant the "so help me god" part of it, and the whole "putting your hand on the bible". Politicians publicly preaching things are NOT in violation of the first clause, as acting like your religion is true is not "congress making a law ". A politician can think any crazy idea he/she wants to. If people want to vote him/her in and their wacky ideas, it's not unconstitutional so long as no actual law is made in favor of it, or against it. (more...)

Open Question: Restaurant repairs it's door with a screw protruding and causes injury, what laws help?
A local national chain restaurant had a broken door which had a board put over the door. The door had a screw protruding through which ripped my coat and poked my arm. Not really injured, but mad because the screw pokes out about an inch and could easily blind a child (it's at a 10 year olds eye level). No signs, and after management was told they didn't repair. I took pictures of door and screw. What are my legal road to teach this company to be safe? Is there a legal precedence that states "company is liable even if the worst case scenario didn't happen". Law experts and students please help!!! It could have been a child. (more...)

Open Question: I'm interested in becoming a lawyer but I don't know if it's the right path for me?
As a side note, I'm earning my degree in business administration. People have joked with me and my mom that we should become lawyers because of the way we argue things/situations in life; me and her are both realists. Now I know that has no weight to it but it's one of the things that got me thinking, originally, about becoming a lawyer. Another, is how my mom and I have dealt with legal maters on four specific situations involving cases of child support, visitation and business matters. I really liked/like being involved with them and trying to help my mom and her lawyer out, by thinking of facts and new angles that could effect the outcome of the cases. Another, is that I like being a leader and helping others; one of the reasons why I'm an Eagle Scout. Lastly, I like hearing about court cases ranging from what's on T.V. to overhearing local DA's that eat lunch where I work. What I'm asking, are there any ideas you might all have that can help me decide if becoming a lawyer is right for me? For example, are there any books or your personal reasons you all had for becoming one yourselves? Additionally, if I were to decide to apply for law school, I'm embarrassed of some of my past grades and had to drop a few classes mid stream for non-failing grade reasons, about 5 classes. Now with much better grades, will admission officers see my future application as the new me or my past self, when reviewing me for admittance? Thank you all for any advice given.
