Resolved Question: will changing tax filing status trigger an audit?
We declared an Informal Marriage in the state of Texas in 2006 at the county clerk's office so we could enter a program for the homeless that would help us become independant. We filed jointly that year--we were both working and going to school. I think I made a mistake by filing Head of Household on my 2007 tax return. I take care of our daughter and depend on the EIC. Will I get audited if I file the same this year?

if it weren't for the Earned Income Credit, then I wouldn't be able to afford things like clothes, new eyeglasses, etc. I'm on a very restricted budget...
i cannot contact my spouse(?) He has to sign the joint return. The state is after him for child support.

Resolved Question: How can I lower a home reassessment after the formal Grievance Process?
My husband and I purchased our home two years ago for 150,000. It was recently reassessed by the town for 311,000.We have a small 3 bedroom house with a detached garage with an in-law apartment over it, all on less then an acre of land. When it was reassessed, the company didn't have a lot of the same situations to compare it to(2 separate buildings on 1 parcel of land), so they compared each to houses worth around 160,000. and added them together! how can they compare the value of a garage (with an apartment) to a house with its own land and its own detached garage? Our mortgage payment has jumped 300 because of the taxes, and we are a family of 7 with only my husbands income. we have small children and can't afford daycare for me to work. We did an informal grievance and it was lowered to 285,000. We missed the formal grievance and figured there was nothing we could do. I found out recently how the company did the reassessment. A rep at the Bureau of Taxation said that the company "Did a lot of creative things". The assessor says there probably could be lowered, but we have to wait until next may to fix it. We probably will lose the house by then. What can we do?
The company is Gar associates. They were hired by the town. I was told by someone in the office of the Bureau of Taxation that "Gar did some creative things."

Resolved Question: Question About Currency Trading And Fund Managing?
I was wondering if you would be so kind as to answer some questions for me?
I have a number of friends who wish me to trade their money in the retail foreign exchange market for them and my worry is one of tax.
My friends are spread out across the globe (I am in England) and my intention was to trade their accounts and for us to split fifty - fifty.
Does anyone have any pointers for me? How do I go about this in as informal a way as possible? I really don't want to bring in lawyers and start an actual business. We all trust each other and they are willing to let me do this on an informal basis. I will trade their accounts and if they make money they will withdraw it and send me half. That is the plan, but what about tax?
If they withdraw profits at regular intervals, do they have to pay tax on the whole amount and then send me half which I will then have to pay tax on too or do they send half right away and we each pay tax on what we receive?
I really don't want to have to set up as a business and be screwed out of even more money just to give the government, so could someone in the know give me an idea the best way to progress? Thank you.

Resolved Question: What can I claim as income to raise my 1040 "earned income" ?
Can I report income (on 1040ez) from tutoring as self employment? I don't have any receipts, but I made a few thousand this year off informal tutoring.
I'm a grad student, so I mostly live off scholarships/grants/loans. No family support. I need to raise my "earned income" for tax reasons.

Resolved Question: Beach weddings--Laguna Beach, CA?
Does anyone know about having a wedding on the beach, not necessarily coordinated through a resort, hotel or restaurant there? My stepson is recently engaged, and by the time of the wedding they are hoping to already be living in California. Since they probably won't know many people out there by that time and just family will be willing to make the trip, it will most likely be like a very small destination wedding. They want something simple, on a beach.
I checked out beaches in LA county, and they have info about having a wedding on the beach (basically no charge, but a permit is required if you are going to be doing any kind of set up (chairs, arch, pillars, etc.). Orange County doesn't have any detailed info, and just says to call the park district for info.
I personally like Laguna Beach, and it seems a little more removed from the craziness of LA (though I've never been there, so I could be wrong). I found a nice resort with a restaurant on the beach, but they charge up to $5,500 just to rent the ceremony and reception location. Food, beverages, tax and gratuity for (minimum) 50 people would be another $8,000. That's over $13,000 for just the ceremony and reception. Plus I doubt it will even be 30 people, much less 50, so we may not even meet their minimum.
Has anyone had or looked into having a small, informal ceremony on the beach in OC and then dinner at a nice restaurant afterward? If so, what are the rules and regulations in Orange County? And can you recommend any mid to upscale beachfront restaurants in Laguna Beach. The wedding party might want to go clubbing afterward, so if you know if any decent night clubs they could hit after dinner, that would be great, too.

Resolved Question: I dont even know what the question should be! ?
Brace yourself this is a long one!! Here is the situation my father in law is a pastor and my husband and I wanted him to be the one to marry us! Well in Feb he was diagnosed with cancer and they told him if he did nothing he would have 4-6 months. He was told he would have better chances with Chemo but they didnt know the odds because all the studies were done in men with this cancer quite a bit older then him. It was rare for a man his age to have it. Anyway my husband and I were planning on getting married in October of this year but decided under the circumstances we should move the date up. Well we didnt even have any money or anything so we took what little tax money we had saved and bought the rings and such and decided we would go ahead and renew our vows in October for the whole family.
My family lives out of state his is local and so in attendance was our parents his brother and sister and my husbands three elderly aunts who we knew would not be able to fly out of town in October. and we only had a week. Well needless to say there were some hurt feelings involved with the rest of the family. That was not my intention really the only person I was thinking about was my father in law I wasnt even considering myself!!
Then in April I found out I was pregnant and well noone wants to be pregnant in a wedding dress so we will not be having a ceremony in October as planned. I am still a girly girl and I want the whole wedding experience. But my question now is this should I have a post elopment reception or not? Was that even considered an elopment we didnt go anywhere and people knew? I have some people saying have the party others are saying its rude since noone was at the wedding. Others are saying do it at our one year and have an informal renewal of vows. I just dont know what to do I really didnt think people would be as offended as they were under the circumstances. We just wanted to make sure his dad was there and we werent sure what was going to happen! HELP ME I cannot afford to hurt anyone else as this was not my intention in the first place. I kind of feel like why cant people see this for the gesture it was I mean not that I minded and I wouldnt have changed a thing but I gave up every girls dream for my husband and his father andI feel like people should see that and not the negative of them not being there!

Resolved Question: Common law marriage recognized when you move to another state?
My husband and I moved from Texas to West Virginia last summer. While we were in Texas, we established an informal/common-law marriage under Texas law.
Under § 2.401 of the Texas Family Code, an informal marriage can be established either by declaration or by meeting a 3-prong test showing evidence of (1) an agreement to be married; (2) cohabitation in Texas; and (3) representation to others that the parties are married. As an example of this, you may have introduced you partner socially as "my husband," or you may have filed a joint income tax return.
My husband and I agreed to be married, lived together for over a year in Texas (and are still living together), and represented to others that we were married. We also signed a Declaration of Informal Marriage and had it notarized for my previous employer. This declaration states that we realize that this marriage is recognized as a legal marriage in all other U.S. states.
We moved to WV and asked a lawyer if we needed to do anything concerning our marriage since TX does not have state income taxes but WV does. We were told that according to Article IV, Section 1 of the United States Constitution (commonly known as the Full Faith and Credit Clause), states within the United States have to respect the ?public acts, records, and judicial rulings? of all other states (i.e. we were told that that state of West Virginia recognizes that we were married in Texas, according to Texas laws, and that we are, in turn, married in the eyes of the state of West Virginia and that we could file our taxes as a married couple here in the state of West Virginia).
Well, we have been filing our federal taxes as married since we started living together and signed our Declaration of Informal Marriage in Texas. We started filing our WV taxes as married this year when we moved here.
The problem is now my company is doing a Dependent Eligibility Audit for health insurance. I have provided the company that is doing the audit with all necessary info, but my employer does not recognize common-law marriage. I have tried to explain to the company that is doing the audit and my company's HR rep that since I have moved from a state that recognizes informal marriage (TX) to another state (WV), that the new state must recognize our marriage as legal.
The problem is that the HR rep called the courthouse and was told that WV does not recognize common-law marriages. This is true...if the marriage originated in WV. It did not.
I have contacted a lawyer that is looking into this and the lawyer believes that I might be able to get an affirmation of marriage from a Family Court judge. The lawyer also said that we are legally married according to all states since we fulfilled the requirements to be married in Texas.
What should I do? Should I try to go to the courthouse here in WV to get a marriage license or is that illegal since I am already married? Should I fight this with a lawyer?

I know that WV doesn't recognize common-law marriages IF the two individuals try to say that they are common-law married while in WV. My question is if a couple is legally common-law married in a state that recognizes common-law marriages and then moves to WV, is that marriage still recognized as a legal one?
